No matter what kind of potential claim you have, there are things you can do to get organized, stay organized, and potentially help preserve and prosecute your claims. Check out these top tips for potential claims.


1. Time is of the essence!

Don’t delay having potential claims evaluated because, for almost all claims, there is a limited time for you to pursue them. If you miss that window of time, you could be forever barred from pursuing them.


2. Document, document, document.

It’s important to keep a record of any event that might be related to your potential claim because it can be difficult to recall specifics later. This can be as simple as making handwritten or electronic notes about what happened and/or taking photographs. It should include the who, what, where, when, and why of the event.


3. Preserve all information that may be related to your potential claim.

This means don’t delete, throw away or otherwise dispose of anything, documents or electronic information such as photos, text messages, or emails that may be related. If your potential claim involves a written promise like a warranty or other contract, make sure you keep that documentation as well.


4. If your potential claim involves attorneys or other representatives whom you have not retained to represent you, do not speak with them until you have first consulted with a qualified attorney about your claim.

Once you retain an attorney, the attorney can speak to those people on your behalf.


5. Finally, create a simple timeline pulling all of this information together.

It should include all events regarding your claim, with associated documents and complete names, addresses, and other contact information for all people who may be involved or who may have information related to your claim. This will be a much easier task if you’re able to follow the steps above. When you meet with an attorney to review your potential claim, the attorney will have a great head start on evaluating your claim.
